Frequently Asked Bankruptcy Questions

Will filing for bankruptcy wipe out all of my debt?

Honestly, filing for bankruptcy will normally wipe out all of your dischargeable debts.  Remember, however, that not all debts are dischargeable when filing for bankruptcy.

What types of debt will be discharged through bankruptcy?

Unsecured debt, credit cards, collection accounts, personal loans, and medical bills are normally dischargeable. However, secured debt, like a mortgage or auto loan, is normally not discharged through bankruptcy, and the loans for this property must be repaid or you could lose it.

What are the differences between Chapter 7 and Chapter 13 Bankruptcy?

Chapter 7 is referred to as liquidation bankruptcy.  The person filing may lose certain unprotected property in Chapter 7. Chapter 7 is for businesses and individuals who have little or no ability to repay their debts.

Chapter 13 is referred to as reorganization bankruptcy.  This type of bankruptcy allows the consumer to reorganize their financial burdens by restructuring their payment schedules.  If you’re filing for Chapter 13, you must submit a budget showing your average income and expenses.  You are not necessarily required to repay all of your debts in Chapter 13, and the amount of your monthly payment depends primarily on how much you can afford to pay.

Can I choose which type of bankruptcy I file? And how do I know I’m choosing the right one?

Anyone can file bankruptcy, but there are certain eligibility requirements for both Chapter 7 and Chapter 13.  Depending on your situation, you may be able to choose between either Chapter 7 or Chapter 13.  In some situations, however, you may not have a choice.
