Arizona First Offense DUI Penalties

In Arizona, the penalties for a first offense misdemeanor DUI vary depending on the severity of the offense.

A first offense is defined as having no prior DUI offenses in the past seven years.

The penalties for DUI Impaired to the Slightest Degree, DUI Over 0.08 alcohol content, or Marijuana/Drug DUI, the minimum penalties include:

  • A minimum of 10 days in jail, potentially reduced to 1 day with successful completion of alcohol or drug education or treatment.
  • Court fines and fees totaling approximately $2000 or more.
  • Suspension of driving privileges for at least 90 days.
  • Installation of an ignition interlock device in your vehicle for one year if it’s an alcohol DUI. No interlock device is required if a marijuana or drug DUI.
  • Mandatory alcohol screening and attendance at alcohol classes.
  • Completion of a traffic survival school course.

For a first offense Extreme DUI, defined as driving with a Blood Alcohol Concentration (BAC) of 0.15% to 0.199%, the minimum penalties are more severe:

  • A minimum of 30 consecutive days in jail, potentially reduced to 2 days in jail and 9 days of home detention with the installation of an ignition interlock device.
  • Fines and fees to the court of approximately $3,500.
  • Suspension of driving privileges for at least 90 days.
  • Mandatory alcohol screening, education, and treatment.
  • Installation of a certified ignition interlock device in any vehicle you operate for 12 months.
  • Possible community service hours.
  • Completion of a traffic survival school course.

For a first offense Super Extreme DUI, defined as driving with a BAC of 0.20% and above, the penalties are even more severe:

  • A minimum of 45 consecutive days in jail, potentially reduced to 3 days in jail and 11 days of home detention with the installation of an ignition interlock device.
  • Fines and fees to the court of approximately $4,000.
  • Suspension of driving privileges for at least 90 days.
  • Mandatory alcohol screening, education, and treatment.
  • Installation of a certified ignition interlock device in any vehicle you operate for 18 months.
  • Completion of a traffic survival school course.
