Help, my spouse walked out and is threatening to stop my insurance, sell the house, or take the kids out of school to move a thousand miles away! Does Arizona law prohibit this?

During the marriage, the spouses can do many things without the interference of law. However, once you file and serve an action for dissolution of marriage, Arizona law places a restraint on both parties from selling the joint property, terminating insurance, bothering the other party or taking the children out of the state without permission. This is an automatic Temporary Restraining Order in every case. (A.R.S. 25-315). In order to get this Temporary Restraining Order, however, you must get moving and file for the divorce as well as serve your spouse with process.
