Please be aware that before Davis Miles can help you, we must confirm that your LegalShield account is active and that there is no conflict of interest in your representation. Davis Miles has many clients and may have in the past represented (or currently be representing) one of the parties involved in your legal matter, or one of the other parties in your matter might be another LegalShield Member. Either of these situations might create a conflict of interest. The Provider Firm Attorney cannot give you legal advice or even listen to the details of your legal matter until all of the names (individuals and organizations) and addresses of the parties involved in your legal matter have been checked against the names and addresses in the LegalShield and the Davis Miles client database.
It is important to be as precise as possible with both the names and the spelling of all related parties. If you have documents concerning your legal matter (police reports, insurance cards, letters, contracts, etc.) review them carefully. If “Johnson” is really spelled “Johnsen”, we may have to withdraw from your case once the error is discovered.
If some parties are not identified at the beginning and a conflict is discovered later, Davis Miles may have to withdraw from assisting you with your legal matter. Also, sometimes as legal matters proceed, a conflict is discovered which could not have been known at the beginning of the matter. This change may require Davis Miles to withdraw from assisting you in order to protect your legal interests.
No attorney should assist two clients with opposing legal interests in the same matter. For example, if you were involved in an auto accident and called Davis Miles using your LegalShield benefits to get legal assistance, you would not want Davis Miles to also be advising the other driver in the accident. It would cause problems in the integrity of the advice being given and would be a violation of the ethical rules that govern attorney conduct.
If a conflict arises, Davis Miles will give you the phone number to the Conflict of Interest Department at LegalShield headquarters in Ada, Oklahoma. The staff in Oklahoma will refer you to another attorney who will assist you with your legal matter. You will still receive ALL of your LegalShield Plan Benefits and Discount Legal Rates from the Referral Attorney.
