Product Liability
“Product liability” is a term that is used to describe a product that is unsafe and causes an injury. In other words, a mistake was made in designing the product, in manufacturing the product, or in telling people how to use the product. Because of the mistake, an innocent user or consumer of the product is injured.
Manufacturers, distributors, and sellers of product have a responsibility to the people who will use the products to make sure the products are safe. If the product is unsafe and causes an injury, the injured person is entitled to compensation for the injuries caused by the unsafe product.
Serious injury or death may be caused by a wide variety of defective or unsafe products including:
- defective tires (tread separations and blow outs);
- cars or SUVs (rollovers, roof crush, seat belts, fuel systems and fires, mechanical failures);
- motorcycles (instability, mechanical);
- farm equipment and machinery;
- industrial equipment and machinery;
- power tools;
- firearms;
- hunting and camping equipment;
- gas stoves, heaters, fireplaces and grills (fires and explosions);
- household products (often electrical);
- medical devices (artificial joints, valves, equipment, pharmaceuticals);
- trailers and jacks;
- playground and school equipment;
- products used by or for babies, infants, and toddlers.
