How long should my claim take?

As usual, there is no way to know with certainty how long it will take. It is more accurate to understand the steps, rather than the timeline.

We are often asked how long we expect our client’s case to take. As usual, there is no way to know with certainty, so it is more accurate to understand the steps, rather than a timeline. First, the client must recover from their injuries. Once the client calls and says he or she is done with treatment, we request the medical records and bills. Most medical offices respond within a reasonable time, but some are surprisingly slow. Within several days of having the documentation, our office prepares a demand package for the insurance company. Once that is sent to the adjuster, we expect to get an offer in about four weeks, at which time the negotiations begin in earnest. Usually, the more complicated the injuries, the longer the time to resolve the claim. If we cannot resolve the claim through settlement, then litigation will be discussed with the client. When litigation begins, court rules control the schedule (more or less).
