What is an uncontested divorce?

An uncontested divorce is one in which there are no disputes or disagreements between the parties as to legal issues. This can take place either through a consent decree or a default divorce. A default happens if the respondent in the divorce does not file a response and enter into negotiations for the terms of the divorce. A consent decree is where both parties have come to an agreement on all issues and sign the agreement, then send it to court for the judge to finalize. Most divorces eventually result in a consent decree, sometimes easily, sometimes after long and difficult negotiations on the terms of the decree and settlement.
